Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website everydayaiapp.com (the "Site") and all services, programs, workshops, consultations, and training materials (collectively, the "Services") provided by Everyday AI Services ("EAI," "we," "us," or "our"). By accessing the Site or enrolling in any Service, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

1. About EverydayAI

Everyday AI Services is a sole proprietorship operated by Milind Bhat, based in Surrey, British Columbia, Canada. EAI provides domain translator training — programs that help professionals and teams build practical AI fluency in the context of their existing expertise.

2. Services Overview

EAI offers the following categories of Services, each subject to specific terms communicated at enrollment:

2.1 AI Confidence Lab

A structured group training program for individual professionals. Includes live sessions, exercises, and access to program materials for the duration specified at enrollment.

2.2 AI Capability Transfer

A team-based training program designed for organizations. Includes customized workshops, domain-specific exercises, and ongoing support as defined in the applicable statement of work or enrollment agreement.

2.3 Workshops

Single-session or short-format training events on specific AI topics. Terms, duration, and pricing are communicated at the time of registration.

2.4 Free Consultations

Complimentary introductory calls offered to prospective participants. These are informational only and do not create any obligation on either party.

3. Enrollment

Enrollment in any paid Service is subject to availability and acceptance by EAI. We reserve the right to decline enrollment if a program is not a suitable fit for a prospective participant.

By enrolling, you represent that: (a) you are at least 18 years of age; (b) the information you provide is accurate and complete; and (c) if enrolling on behalf of an organization, you have authority to bind that organization to these Terms.

4. Payment Terms

All fees are stated and payable in Canadian Dollars (CAD) unless otherwise agreed in writing. Payment processing is handled through Stripe. By providing payment information, you authorize EAI and Stripe to charge the applicable fees.

4.1 Individual Programs

Payment is due in full at the time of enrollment unless a payment plan has been explicitly agreed to in writing.

4.2 Team Programs

Invoices for team programs are net-15 (due within 15 days of the invoice date) unless different terms are specified in the applicable statement of work.

4.3 Late Payments

Invoices not paid within the agreed timeframe may be subject to a late fee of 1.5% per month on the outstanding balance. EAI reserves the right to suspend access to Services until overdue amounts are resolved.

5. Cancellation and Refund Policy

More than 7 days before the program start date: You may cancel for a full refund. Refunds will be processed to the original payment method within 10 business days.

7 days or fewer before the program start date: No refund is available, unless the program is cancelled by EAI.

After the program has started: No refunds are available for partially completed programs.

Cancellation by EAI: If EAI cancels a program for any reason, enrolled participants will receive a full refund.

6. Intellectual Property

6.1 EAI Materials

All program materials, frameworks, curricula, exercises, templates, and content created by EAI ("Program Materials") are the intellectual property of Everyday AI Services. Participants receive a limited, non-exclusive, non-transferable license to use Program Materials for their own professional development. Participants may not reproduce, distribute, sell, teach from, or create derivative works from Program Materials without prior written consent from EAI.

6.2 Participant Work Product

Any work product created by participants during a program (prompts, workflows, outputs, etc.) remains the intellectual property of the participant or their employer, as applicable.

7. Confidentiality

Both parties agree to keep confidential any non-public information shared during the course of a program, including but not limited to business processes, strategies, data, and proprietary methods ("Confidential Information").

Confidential Information does not include information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was already known to the receiving party prior to disclosure; (c) is independently developed without reference to the disclosing party's information; or (d) is required to be disclosed by law.

Confidentiality obligations survive termination of these Terms for a period of two (2) years.

8. Data Security

EAI implements reasonable administrative, technical, and physical safeguards to protect participant information. However, no method of electronic transmission or storage is 100% secure. Participants are responsible for maintaining the security of their own account credentials. For details on how we handle personal information, see our Privacy Policy.

9. Third-Party Tools

Our Services may involve the use of third-party tools and platforms, including but not limited to Anthropic's Claude AI. Participants acknowledge that:

  • Third-party tools are governed by their own terms of service and privacy policies.
  • EAI is not responsible for the availability, accuracy, or performance of third-party tools.
  • Participants should review applicable third-party terms before using such tools.
  • Any data shared with third-party tools during program exercises is subject to those tools' data handling practices.

10. Acceptable Use

When using the Site or participating in Services, you agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable laws.
  • Share login credentials or program access with unauthorized individuals.
  • Record, screenshot, or distribute program sessions without prior written consent.
  • Harass, disrupt, or act disrespectfully toward other participants or EAI staff.
  • Attempt to reverse-engineer, scrape, or extract proprietary content from the Site or program materials.
  • Misrepresent your affiliation with EAI or your completion of programs.

EAI reserves the right to remove any participant who violates these terms, without refund.

11. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

EAI provides education, training, and frameworks. We do not guarantee specific outcomes, career advancement, revenue increases, or productivity gains. Results depend on participant effort, application, and individual circumstances.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EAI'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO EAI FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL EAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

13. Indemnification

You agree to indemnify, defend, and hold harmless EAI and its owner, contractors, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of British Columbia, sitting in Vancouver. Before initiating formal proceedings, both parties agree to attempt good-faith resolution through direct communication for a minimum of thirty (30) days.

15. Modifications to Terms

EAI reserves the right to update these Terms at any time. Material changes will be communicated by posting the updated Terms on the Site with a revised "Last updated" date. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms. For participants enrolled in active programs, material changes to terms affecting that program will be communicated directly via email.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any applicable enrollment agreement or statement of work, constitute the entire agreement between you and EAI with respect to the Services and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
